Determining Factors of Negligence

While money is often inadequate to compensate an injured person for the damages one incurs following an accident—whether pain and suffering, permanent injuries, medical costs, lost wages, stress and emotional trauma—our legal system allows recovery when each of the following four criteria exists:

  • There is a duty owed (as in the duty a driver has to drive in a reasonably safe manner)
  • The duty owed was breached (where the driver breached his duty to drive in a reasonably safe manner when he failed to keep a reasonable distance from the car in front of him)
  • Causation (the breach or negligence caused the accident)
  • The negligence (of the driver) caused the injuries
Determining Compensation

The law states that the amount of compensation must be fair, just and reasonable. While there is no formula to determine a fair, just and reasonable award, the following factors are considered in evaluating the value of a case:

  • Nature and extent of injuries
  • Total medical bills and other out-of-pocket expenses
  • Pain and suffering
  • Lost wages
  • Any permanent partial disability that is determined and assessed by your doctor
